Section 1 – Formation of the contract

A contract between the customer and the hotel is formed as soon as the hotel confirms and thereby accepts ordered rooms, meeting rooms or other service units, whether ordered orally or in writing. A reservation constitutes an order. The contract is formed in the form in which it was accepted. Written confirmation is required in every case, and its content is deemed agreed.

The identity of our contractual partner follows from the designation in the confirmation. Any incorrectly stated representation arrangement must be reported immediately in writing. We recommend taking out travel cancellation insurance.

Section 2 – Preliminary reservations and options

Preliminary reservations, allotments and option reservations are binding on both parties. Definitive dates must be set no later than the agreed expiry date. Otherwise, the preliminary reservations, allotments and options expire.

Section 3 – Arrival and departure

Hotel and guesthouse rooms are available from 14:00 on arrival, or as agreed, and until 10:00 on departure, or as agreed. Unless a later arrival time has been arranged, the hotel may allocate rooms elsewhere after 18:00.

Section 4 – Event rooms

Meeting and other event rooms are available to the organiser at the agreed times. The hotel must be informed in good time if the rooms are needed for longer.

Section 5 – Provision

The hotel endeavours to provide specific event rooms and bedrooms. If this is not possible, it reserves the right to make a short-notice change without this giving rise to claims for damages.

Section 6 – Cancellations

Cancellations must be made in writing. Where the cancellation period is three days, 100 per cent of the agreed service price is due unless the booking confirmation provides otherwise. This applies to bedroom bookings, meetings and events.

The hotel endeavours to reallocate unused reservations. To the extent that it succeeds, the customer incurs no costs.

Section 7 – Group travel

Reservations of five rooms or more are considered group travel. Written cancellation is free of charge up to 56 days before arrival. After that, unless the booking confirmation provides otherwise, 80 per cent is due for bed and breakfast, 70 per cent for half board and 60 per cent for full board.

Changes to an order may lead to price changes. The hotel endeavours to reallocate unused reservations.

Section 8 – Changes in guest numbers

For events, a change in guest numbers may be notified without cost up to two days in advance. A seven-day period applies where special menus have been agreed.

Section 9 – Organiser liability

As organiser, the customer is liable for payment of services used by participants and for damage they cause to the hotel inventory.

Section 10 – Non-smoking hotels

Our hotels are non-smoking. Smoking is prohibited in public areas and guest rooms and is permitted only in designated areas. In the event of a breach, the hotel may claim the cleaning and loss-of-use costs actually incurred. A higher or lower loss may be demonstrated.

Section 11 – Emergency and fire-safety equipment

A person who intentionally or negligently triggers alarm or fire-safety equipment, or their legal guardian, is liable at least for the costs actually incurred. Damaged or disabled components of fire-safety equipment will be charged to the person responsible.

Section 12 – Pets

Bringing pets requires the hotel's prior consent. Animals must remain under the guest's supervision, be free from disease and pose no danger. They are not permitted at breakfast or in event rooms. Assistance dogs are exempt and may accompany guests free of charge.

Section 13 – Due date

Invoices are due in full upon receipt.

Section 14 – Price agreements

Anyone relying on a fixed or special-price agreement that differs from the usual price list bears the burden of proving it. If more than six months elapse between reservation and event, the price valid at the time of the event applies.

Section 15 – Liability and damage

The hotel endeavours to remedy technical defects without delay. It is liable for loss of and damage to items brought onto the premises in accordance with statutory provisions. Liability for guests' vehicles is excluded to the extent permitted by law.

Damage to and extreme soiling of inventory may be charged at the costs actually incurred.

Section 16 – Written form

Agreements between the customer and the hotel must generally be made or confirmed in writing. Oral side agreements are not binding.

Section 17 – Place of performance and law

The place of performance is Munster and the place of jurisdiction is Soltau. German law applies; the UN Convention on Contracts for the International Sale of Goods is excluded.
